§ 1 Scope and contracting parties
- These terms apply to all contracts between Unity Consulting Group LLC, 30 N Gould St Ste R, Sheridan,
WY 82801, USA, EIN 98-1883636, represented by its authorised representative (the „Provider“), and its
customers concerning the services described in § 2.
- A consumer is any natural person who enters into the contract for purposes that are predominantly
outside their trade, business or profession.
- The Provider operates under the name „People for People“, used under a licence agreement with
People for People e. V. The association is not a party to the contracts described here and bears no
liability for them.
- For contracts with consumers habitually resident in the European Union, the mandatory consumer
protection provisions of their state of residence apply.
§ 2 Services
- Compass: a video call lasting 90 minutes and a written summary of two to three pages
provided afterwards, containing an assessment of the situation, a recommended order for the next steps,
the naming of suitable expert partners and a rough cost estimate. Also included is the answering of one
follow-up question by email within seven working days.
- The Provider owes a careful performance of the service, not a particular outcome. In particular, no
specific result of an emigration project is owed.
§ 3 No legal, tax or investment advice
- The Provider’s services are orientation and organisation services. They do not constitute legal advice,
tax advice, investment advice or investment brokerage.
- The Provider names suitable expert partners. Professional advice is given exclusively by those partners,
in their own name and on their own account. Any contract with an expert partner is concluded solely between
the customer and that partner.
- The Provider receives a commission from expert partners for establishing the contact. This is disclosed
before any referral.
- Costs may arise for the services of expert partners. For tax and legal advice a fee is payable for the
consultation itself. In all other areas, costs arise only once a service is commissioned. The respective partner
informs the customer of the amount in advance. The Provider makes no commitments in this regard and does not
owe any particular terms.
§ 4 Conclusion of contract
- The presentation of services on the website is not a binding offer but an invitation to book.
- By selecting an appointment, entering their details, confirming the required declarations and submitting
the booking, the customer makes a binding offer.
- The contract is concluded upon receipt of the booking confirmation by email. The contract text is stored
and provided to the customer in text form together with the confirmation.
- The contract language is German or English.
§ 5 Prices and payment
- The price for the Compass is EUR 500.00. All prices are final prices; any value added tax that may apply
is included.
- Payment is made by credit or debit card via the payment service provider Stripe, or by bank transfer. Where payment is made by bank transfer, the amount is due
within seven days of the invoice date and in any event before the agreed appointment.
- The appointment is deemed firmly reserved once payment has been received.
§ 6 Customer’s duty to cooperate
- The customer completes the questionnaire sent before the appointment and provides the information
required for the service completely and accurately.
- The quality of the written summary depends on the completeness of that information. The Provider is not
liable for disadvantages arising from incomplete or inaccurate information.
§ 7 Rescheduling and cancellation
- The customer may cancel or reschedule the appointment free of charge up to 48 hours before it begins.
Where notice is given in time, the Provider will first offer an alternative appointment. If no alternative
appointment is agreed, or the customer does not wish one, the Provider will refund the amount paid in full.
- Where cancellation occurs within 48 hours of the appointment, the Provider will offer an alternative
appointment. There is no entitlement to a refund in that case.
- If the customer does not attend without cancelling, the service is deemed to have been used.
- If the Provider has to cancel the appointment, it will offer an alternative appointment. If no
alternative appointment is agreed, it will refund the full amount.
- This paragraph does not affect the statutory right of withdrawal under § 8.
§ 8 Right of withdrawal
- Consumers have a statutory right of withdrawal in accordance with the
withdrawal policy.
- In the case of a service, the right of withdrawal expires once the Provider has fully performed the
service and began performance only after the customer gave their express consent and at the same time
acknowledged that they would lose their right of withdrawal upon complete performance of the contract.
- If the customer withdraws after the Provider has begun performance at their express request, the customer
owes compensation for the value of the services provided up to the withdrawal. That compensation is
calculated proportionately to the agreed total price. Holding the call accounts for 70 % and preparing the
written summary for 30 % of the overall service.
§ 9 Liability
- The Provider is liable without limitation in cases of intent and gross negligence, for injury to life,
body or health, and under mandatory statutory provisions.
- In the case of a slightly negligent breach of a material contractual obligation, liability is limited to
the foreseeable damage typical of the contract. Liability is otherwise excluded.
- The Provider is not liable for the services of expert partners.
§ 10 Confidentiality
The Provider treats all personal and financial circumstances that become known in the course of the
service as confidential and passes them on to expert partners only with the customer’s express consent.
§ 11 Dispute resolution
The Provider is neither willing nor obliged to participate in dispute resolution proceedings before a
consumer arbitration board.
§ 12 Final provisions
- German law applies. Mandatory consumer protection provisions of the customer’s state of residence remain
unaffected.
- Should any provision be invalid, the validity of the remaining provisions is unaffected.
